TERMS OF SERVICE

General Terms of Service

Thank you for using Cloudsave. These Terms of Service (“Terms”) govern your use of our cloud storage service, client software, and website (the “Service”). Your agreement is with AXSA Technologies Private Limited, an Indian company (the “Company”, “we”, “us”, or “our”). Our Privacy Policy explains how we collect and use your information. By using the Service, you agree to be bound by these Terms and our Privacy Policy.

Parent or Guardian Permission

If you are under 18 or a minor under the laws of your country, you must review these Terms with your parent or guardian and use the Service only with their consent. Due to the nature of the internet, we cannot verify guardian consent individually, so you are responsible for obtaining it.

Children Policy

We do not knowingly collect or solicit personal information from children under 13 (or the age of majority in your jurisdiction) or allow them to use our Service. If you are under 13, do not send us any personal information, including your name, address, phone number, or email address. If you believe a child under 13 has provided such information, contact us immediately at support@cloudsave.org, and we will promptly remove it from our records.

User Data & Permissions

When you use the Service, you may upload files such as documents, photos, or videos (“User Data”). These Terms do not grant us any rights to your User Data except for the limited permissions needed to provide the Service, such as hosting, storing, and creating backups of your User Data. You grant us and our affiliates or trusted third-party partners permission to access, store, and process your User Data to deliver the Service. Our Privacy Policy provides more details.

Acceptable Use Policy

User Responsibilities

You are responsible for your actions and the outcomes of using the Service, including interactions with other users. Your use must comply with our Acceptable Use Policy. You may not upload, download, or share content unless you have the legal right to do so.

We may review your conduct and content for compliance with these Terms and our policies. We may remove or refuse content that violates our policies or applicable laws, but we do not routinely review content, so do not assume we do.

Keep your password secure and your account information current. Do not share your account details or allow others to access your account. You are responsible for maintaining backups of your User Data.

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. If you are a minor, you confirm you have parental consent. Your use must comply with applicable laws, including export control regulations.

Software

The Service may include client software (“Software”) for download, which may update automatically. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Software solely for the Service, provided you comply with these Terms. If the Software includes open-source components, we will provide the relevant licenses, which may override parts of these Terms. You agree not to reverse engineer, decompile, or assist others in doing so, unless permitted by law.

Company Property

The Service is protected by copyright, trademark, and Indian and international laws. These Terms do not grant you any rights to the Service, third-party content, or our trademarks, logos, or brand features.

Copyright

We respect intellectual property rights and expect our users to do the same. We respond to notices of alleged copyright infringement under the Indian Copyright Act, 1957. We may delete or disable infringing content and terminate accounts of repeat infringers.

If you believe your copyright has been infringed, submit a Notice of Alleged Infringement to support@cloudsave.org, including:

Subscription Storage Upgrades & Paid Features

Additional storage or features are available through paid plans (“Paid Service”). The Paid Service is available until your subscription expires. Subscriptions renew automatically (monthly or annually) unless canceled before the renewal date. We will charge the subscription fee at purchase and upon each renewal, regardless of your usage.

You may cancel your subscription at any time via https://cloudsave.org/account or your app store for in-app purchases. No refunds will be provided for fees paid before cancellation, including after automatic renewals.

If you fail to pay for the Paid Service on time, we may restrict your storage to 1TB (free account limit). If your storage exceeds 1TB, you cannot upload new data or use certain features until you reduce usage below 1TB.

We may change fees, and it is your responsibility to review these Terms periodically for updates.

Subscription and Auto-Renewal Terms

Subscription Period: The Paid Service is available for the duration of your subscription period (e.g., monthly or annually), as selected at purchase. You will have access to the Paid Service until the subscription expires or is canceled.

Auto-Renewal: Your subscription will automatically renew at the end of each billing cycle (e.g., monthly or annually) unless you cancel it at least 24 hours before the renewal date. The same payment method used for the initial purchase will be charged at the rate applicable at the time of renewal, which may start up to 24 hours before the new billing cycle begins.

Price Changes: If the subscription price changes, the new price will apply to the next billing cycle. It is your responsibility to review the subscription terms for updates. You may cancel your subscription if you do not wish to pay the new price, as described below.

Access After Cancellation: If you cancel your subscription, you will retain access to the Paid Service until the end of the current billing cycle for which you have paid. No further charges will apply after cancellation. For example, if you purchase an annual subscription on January 1, 2025, for ₹1,000 and cancel on July 1, 2025, you will have access until December 31, 2025, and no additional charge will apply on January 1, 2026.

Non-Refundable: Subscription fees are non-refundable, except as required by applicable law or as specified in our refund policy or the refund policies of Google Play or the App Store.

Payment Plans: If you commit to a multi-payment plan (e.g., installment payments for an annual subscription), you cannot cancel remaining payments for the current plan but can stop auto-renewal for future cycles. You remain responsible for all payments in the current plan.

Free Trials: If you subscribe to a free or discounted trial, you must cancel at least 24 hours before the trial ends to avoid charges. Upon cancellation during the trial, you will lose access to the Paid Service unless otherwise specified.

How to Cancel Auto-Renewal

You may cancel your subscription’s auto-renewal at any time to prevent future charges. Cancellation must be processed through the platform where you purchased the subscription (Cloudsave website, Google Play for Android, or App Store for iOS). Uninstalling the Cloudsave app will not cancel your subscription. Below are instructions for canceling on Android and iOS.

Canceling on Android (Google Play)

  1. Open the Google Play Store app on your Android device.
  2. Ensure you are signed in with the Google Account used for the subscription.
  3. Tap your profile icon in the top-right corner.
  4. Select Payments & Subscriptions, then tap Subscriptions.
  5. Find and select the Cloudsave subscription you wish to cancel.
  6. Tap Cancel Subscription and follow the on-screen instructions.
  7. You will receive a confirmation email from Google Play upon successful cancellation.

Note: Cancel at least 24 hours before the renewal date to avoid charges for the next billing cycle. You will retain access to the Paid Service until the end of the current billing cycle. If the Cloudsave app is removed from Google Play, your future subscription will be canceled automatically, but past subscriptions are non-refundable unless specified in Google Play’s refund policy.

Canceling on iOS (App Store)

  1. Open the Settings app on your iPhone or iPad.
  2. Tap your name or Apple ID at the top of the screen.
  3. Tap Subscriptions. If you don’t see Subscriptions, tap iTunes & App Store, then tap your Apple ID, sign in if prompted, and select Subscriptions.
  4. Select the Cloudsave subscription you wish to cancel.
  5. Tap Cancel Subscription and confirm the cancellation.
  6. You will see no renewal option selected, confirming the subscription will not renew.

Note: Cancel at least 24 hours before the renewal date to avoid charges for the next billing cycle. You will retain access to the Paid Service until the end of the current billing cycle. If you subscribed to a free or discounted trial, cancel at least 24 hours before the trial ends to avoid charges. Refunds are subject to Apple’s refund policy.

Canceling via Cloudsave Website

  1. Log in to your Cloudsave account at https://cloudsave.org/account.
  2. Navigate to Subscription Settings or Billing.
  3. Select the option to Cancel Subscription and follow the prompts to confirm.
  4. You will receive a confirmation email upon successful cancellation.

Note: Cancel at least 24 hours before the renewal date. You will retain access until the end of the current billing cycle. Refunds are subject to Cloudsave’s refund policy or applicable law.

You may stop using the Service at any time. We may suspend or terminate your access with notice if:

Change or Discontinuation of Service

We strive to provide reliable cloud storage but may change, limit, or discontinue the Service or its features without notice for business reasons. This may include reducing free storage if your account is inactive for a reasonable period or introducing fees for previously free features. If we discontinue the Service before the end of a paid term, we will refund the unused portion of your prepaid fees.

Service “AS IS”

THE SERVICE IS PROVIDED “AS IS.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, SUPPLIERS, AND DISTRIBUTORS MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FOR MERCHANTABILITY, FITNESS FOR PURPOSE, OR NON-INFRINGEMENT.

Resolving Disputes

Before filing a claim, contact us at support@cloudsave.org to resolve disputes informally. We will respond via email within 15 days. If unresolved, you or we may pursue arbitration under the Indian Arbitration and Conciliation Act, 1996, in Bengaluru, India, with one arbitrator appointed per the Indian Council of Arbitration rules. Disputes will be governed by Indian law and resolved in Bengaluru courts, subject to local consumer laws granting rights to use local courts.

Controlling Law

These Terms are governed by Indian law, excluding its conflict of law principles.

Entire Agreement

These Terms, along with our Privacy Policy, Cookie Policy, and Takedown Guidance Policy, form the entire agreement between you and us regarding the Service, superseding any prior agreements. These Terms create no third-party beneficiary rights unless stated.

Waiver, Severability & Assignment

Our failure to enforce a provision is not a waiver of our right to do so later. If a provision is unenforceable, the remaining provisions remain effective, and a substitute term will reflect our intent. You may not assign your rights under these Terms. We may assign our rights to affiliates, subsidiaries, or successors.

It is your responsibility to review these Terms periodically for updates. Updates will take effect no less than 30 days from posting on our website. If you disagree, stop using the Service before the updates apply. Continued use after the effective date means you accept the revised Terms.
